| ADULT CONTENT Body Republic is committed to supporting user’s ability to post a wide variety of content. Content posted on Body Republic is intended for adult readers and is not intended for minors. We feel it is important for parents to take an active role in ensuring their children do not encounter inappropriate Content while on Body Republic or the internet. We have provided a list of Resources to assist women and parents with adhering to safe internet practices. Body Republic content will be reviewed and content that is graphic and/or explicit in nature will be flagged as containing explicit adult content whereas content that is not graphic or explicit in nature will have no action taken. COPPA VIOLATION The Children’s Online Privacy Protection Act (COPPA) requires online service providers based in the United States to take a number of measures related to the collection of information from people under the age of 13. Because of those provisions, if we are made aware of a statement on Body Republic servers that any person is under the age of 13 we will take the following actions:

CHILD PORNOGRAPHY AND EXPLICIT IMAGES OF MINORS Body Republic has zero tolerance for child pornography and in compliance with United States statute any photograph, video, or other similar content which would lead an ordinary person to conclude that it depicts an actual minor engaged in sexually explicit conduct will be addressed as follows:

While discussing illegal activities may not be illegal itself, posting Content which is intrinsically illegal, or is soliciting, instructing, or encouraging others to violate the law can be. Content of this nature will be disabled and continued use will be denied. Federal Statutes clearly state, any threat to kill, kidnap, or harm the President of the United States is illegal and will result in disabling Content, discontinuation of use and report to the appropriate authorities. In the case of Content which is intrinsically illegal such as attempting to buy or sell things which are illegal or to distribute, or Content which solicits, instructs or encourages illegal activities will result in access to the post being disabled and further use will be denied. This policy does not cover material which merely discusses illegal activities from a theoretical, academic, or personal experience viewpoint. As noted in our Terms and Conditions, Body Republic is based in and as such is governed by U. S. Federal Law and the Laws of the State of Oregon. Users not residing in the U. S. are still required to abide by U. S. Law while on Body Republic. INAPPROPRIATE CONTENT Body Republic has zero tolerance for Content which incites, encourages, or advocates pedophilia, the abuse or neglect of children in any way, or the act of rape. Users choosing to post Content of this nature will be denied use, Content will be disabled and as appropriate (as deemed by Body Republic) reports will be made to the appropriate authorities. OBJECTIONABLE USERPIC Any and all pictures posted by Body Republic users are expected to adhere to all policies stated in this document as well as the Terms and Conditions. Userpics exhibiting graphic nudity, pornography, abuse, violence, neglect will be disabled. Images portraying non-sexualized/non-violent nudity (for example, mother’s breastfeeding or artwork- Statue of David) are not considered objectionable. Body Republic reserves the right to review all images in question and disable pictures as they deem appropriate. HARASSMENT Body Republic has zero tolerance for harassment and is committed to supporting a safe and diverse online community. Body Republic is a place many people use to talk about their lives and that often includes talking about other people. Users are encouraged to keep in mind balancing their individual rights to discuss topics important to you with the individual privacy rights of others. Users whose statements encourage or incite others to harass another person in any way will no longer have access and Content will be disabled. If Content states negative feelings or opinions of another person, no action will be taken. We encourage users who feel they are being harassed to email Body Republic with a clear statement of the concern. IMPERSONATION Body Republic recognizes Identity Theft is a serious problem that has a lasting and profound impact on its victim. Users are not permitted to claim to be someone else or take actions or make statements resulting in damage to the actual person. Users choosing to impersonate another individual will be denied access to the Service and Content will be disabled. INVASION OF PRIVACY Body Republic is committed to providing a safe and diverse online community for users and does not permit the posting of Content invasive to another person’s privacy. Posting the full name, email address, telephone number, Social Security/Social Insurance/National Insurance number (or similar) and/or postal mail address of another or material that is sufficient for an unconnected reader to obtain the same removes the person’s ability to control who has access to that information and will result in Content being disabled and continued use denied. Body Republic reserves the right to require proof of identity at anytime an invasion of a user’s privacy is in question. It is not considered an Invasion of Privacy to reproduce information a user has previously publicly disclosed on the Service. HATE SPEECH Body Republic has zero tolerance for Content which encourages, incites, or advocates harm or violence against a specific person or group of people. Body Republic is committed to providing a safe and diverse online community. Content exhibiting the above criteria will be disabled and continued use will be denied. Hate speech is a crime. Body Republic encourages users to become familiar with Federal and State Statutes regarding hate speech. This policy does not apply to Content which is clearly a hyperbole or satirical. SELF HARM Body Republic recognizes users engage in behavior deemed by others to be self-destructive and is committed to providing a safe and diverse online community that allows users to discuss and seek support regarding self-harming choices and behavior. Content which only discusses self-harming choices and behavior, in positive or negative terms is not prohibited. Body Republic does not support Content which either encourages or instructs others to engage in self-harming behavior. Content that encourages or instructs others to engage in self-harming behavior will be disabled. SUICIDAL POSTS Suicide is a very serious matter, and we believe it is our responsibility to notify proper authorities when we are made aware of a Body Republic user attempting to commit suicide. While we may not be legally required to do so, we feel it is our moral and ethical obligation to take any and all action we can to prevent the potential loss of someone’s life. When Body Republic receives a report indicating a user is at risk for suicide: If the user has stated in no uncertain terms that (a) he or she intends to commit suicide, (b) his or her stated plans are currently happening or scheduled for a specific time, and (c) we are able to determine sufficient information for the police to locate the user (full name and either address or telephone number), the user’s local authorities will be contacted, provided with the information available, and the caller will urge the authorities to send an officer to the user’s location for a "wellness check". If all three of these conditions are not met, no action can be taken. IF

THREATENING CONTENT Body Republic is committed to providing a safe and diverse online community and has zero tolerance for user Content that is threatening. We acknowledge that removing Content that is threatening will not remove an individual’s intent to act and in many cases may hinder authorities’ ability to investigate a matter. No action will be taken if user Content is clearly satirical, hyperbolic or demonstrates the user posting has neither the ability nor intent to carry out the threat. In all cases where a user indicates they feel threatened, they should be advised to contact their local authorities. No action should be taken until the person being threatened has confirmed that action by Body Republic will not destroy evidence for any criminal investigation they may pursue. If confirmed, access to the entry will be disabled. Repeat offenders may have further action taken against their account. COMMERCIAL ACTIVITY Users wishing to post information about commercial ventures they are involved in should email Body Republic prior to posting. Media outlets and advertisers wishing to advertise on Body Republic should consult our Advertising Policy. Body Republic is not a service designed for the purchase or sale of goods or services, and we will be unable to assist in resolving disputes among people who choose to buy or sell things on Body Republic. Users who engage in commercial activity on Body Republic do so entirely at their own risk. If you are located in a country embargoed by the United States, or are on the U. S. Treasury Department’s list of Specially Designated Nationals you will not engage in commercial activities on Body Republic (such as advertising or payments) or operate a Platform application or website. COPYRIGHT VIOLATION The Digital Millennium Copyright Act sets forth provisions for what an online provider must do to remain compliant with United States Copyright Law. Upon receipt of a notification compliant with the Digital Millennium Copyright ACT (DMCA), access to material will be disabled. Body Republic does not make legal determinations regarding use of Content allegedly infringing on another person’s copyright, such as whether or not use of the Content qualifies as "fair use". Users who feel they have a legal right to use the material may counter-notify; we strongly advise that they consult with a lawyer before filing a counter-notification. Users who repeatedly disregard DMCA and Copyright laws will be terminated/denied use. Copyright Policy http://www.copyright.gov/legislation/dmca.pdf EVASION OF TERMINATION Users who have previously been terminated are not permitted to continue use without permission from Body Republic. Users who have previously been terminated and wish to continue use should email Body Republic. All users are expected to abide by the Terms and Conditions. SPAM People almost unanimously agree that spam is unwanted. Body Republic does not permit users of the Service to post a large number of unsolicited materials. Users are encouraged to mark as spam materials they believe to be spam and report the concern via email to Body Republic. Emailed concerns will be reviewed and acted upon by Body Republic periodically. Users determined to be "spamming" will receive an initial warning. Continued spamming by users will result in discontinuation of use. THIRD-PARTY REQUESTS Though Body Republic encourages its users to act as allies in maintaining a safe and diverse online community we feel it is important to receive concerns directly from the individuals involved, even though the person deemed to be of concern may not have any objections. Body Republic will advise all Third Party Requests that the person(s) directly involved in the situation of concern or someone legally authorized to act for them will need to initiate the email to Body Republic. Requests from Third Parties may be considered if there is clear evidence that the person(s) directly involved cannot submit a request on their own behalf. Effective Date: April 11, 2010 |
